This bill aims to prohibit smoking in motor vehicles when a child is required to be secured by a child passenger restraint system. It amends the existing law by adding a new subsection that bans smoking in such vehicles and imposes a $100 fine for violations. The bill also specifies that law enforcement agencies will enforce this provision, but officers cannot search or inspect the vehicle solely due to a violation. During the first 90 days, officers will issue warnings instead of citations. Additionally, the violation will not be considered contributory negligence in civil actions or count as a moving violation for the purpose of determining insurance surcharges.
