This bill aims to protect consumers from unreasonable utility rate increases. It proposes two key provisions: 1) The Department of Public Utilities cannot approve an allowed return on equity for electric or gas companies that is higher than the average allowed return on equity approved in neighboring states over the preceding 4 years, unless the company can show that would violate its constitutional rights. This does not include compensation related to certain energy efficiency and performance programs. 2) The Department cannot approve a performance-based ratemaking mechanism for electric or gas companies that automatically results in annual revenue increases higher than the rate of inflation, such as through a negative productivity factor or offset.
