This bill aims to protect youth from secondhand smoke by prohibiting smoking in multi-unit residential buildings, including inside individual units and commercial spaces attached to these buildings. The prohibition will apply to buildings with municipal authorization of residential occupancy issued on or after January 1, 2022, and all other multi-unit residential buildings by January 1, 2023. The bill also amends existing law to include condominium unit owners in the definition of "tenant" regarding smoking restrictions. The Massachusetts Department of Public Health will be responsible for implementing and enforcing this law, and the bill allows for further restrictions by the Commonwealth or its subdivisions.
