This bill establishes individual standing, allowing the Attorney General or any person to maintain an action in the Superior Court against any person for the protection of the air, water, and other natural resources from pollution, impairment, degradation, or destruction. The bill states that persons domiciled in the Commonwealth shall have standing to sue on behalf of the public, regardless of whether the plaintiffs suffer substantial damage not common to others similarly situated. However, plaintiffs who did not show that they used, had access to, or enjoyed a recreational, aesthetic, cultural, spiritual, or economic interest in the subject environment lack standing to assert a MEPA (Massachusetts Environmental Policy Act) claim concerning those areas.
