This bill proposes several key changes to Chapter 190B of the General Laws in Massachusetts to provide additional protections against predatory guardianship. Specifically, it amends Section 5-304 to require that notice of a guardianship proceeding be provided to the person's legal counsel, if the person has retained one, as well as any other person as directed by the court. It also requires the notice to inform the person of their legal rights, including the right to legal representation and the right to be present at all hearings. Additionally, the bill amends Section 5-305 to require that any other person appointed as a guardian be certified as a National Certified Guardian by the Center for Guardianship Commission within 6 months of their appointment. Finally, it amends Section 5-309 to require that the guardian's decision-making, as well as any related expenses charged to the incapacitated person's estate, be clearly specified.
