This bill amends the existing law to further regulate the appointment of certain guardians by the Probate Court. The key provisions are: (1) it establishes a presumption that the spouse, parent(s), or any person the court deems appropriate are the proper persons to be appointed as guardian of an incapacitated person, provided that such presumption can be rebutted by competent evidence; and (2) it allows a spouse or parent(s) to freely designate a third party to serve as guardian, and in such cases, the designated party shall be presumed to be the proper person to be appointed, subject to the same rebuttable presumption.
