This bill requires all retail gasoline stations in the state to be equipped with and maintain alternative power generation devices, such as backup generators, to enable them to continue selling motor fuel during power outages caused by declared states of emergency or disasters. The bill also authorizes the state's Division of Standards, in consultation with the Massachusetts Emergency Management Agency, to inspect the stations and ensure compliance. Stations that fail to comply may face civil penalties. The bill provides an exception if the failure to use the backup power is due to physical damage sustained during the emergency. The bill also directs the relevant department to establish rules and regulations to administer the provisions, and it will take effect one year after enactment.
