This bill amends existing law to require the Attorney General and each District Attorney to annually report on the use of administrative subpoenas to obtain telephone and internet records without judicial review. The report must include details such as the number of subpoenas issued, the entities subpoenaed, the types of records requested, the number of criminal cases initiated and convictions obtained using information from the subpoenas, and the number of successful motions to quash the subpoenas. The reports must be filed with the legislature and published online as a public record. The bill also allows any person to compel compliance with the reporting requirements through a mandamus action in court, and authorizes the court to award costs and attorney's fees if the failure to comply was a willful violation.
