This bill amends Chapter 239 of the General Laws to establish a two-tier process for summary process cases (i.e., eviction proceedings). The first tier involves a hearing to determine the status of the case, explore available resources, attempt mediation, and identify next steps. No default or dismissal can be entered if a party does not appear at the first tier event. For cases that are not resolved, the second tier involves a written notice of the trial date. Additionally, the bill requires courts to grant a continuance in a summary process action for nonpayment of rent if there is a pending application for rental assistance, and prohibits the court from issuing a judgment or execution, or staying an execution, if there is a pending rental assistance application.
