This bill amends the General Laws of Massachusetts to clarify the employment status of workers under a Professional Employer Organization (PEO) arrangement. Specifically, it establishes that both the client company and the PEO or PEO group are considered the employer for the purposes of sponsoring retirement and welfare benefit plans for the "Covered Employees" under the PEO arrangement. It also treats a fully-insured welfare benefit plan offered by the PEO or PEO group as a single employer welfare benefit plan under state law, and considers the PEO or PEO group as the employer for the purposes of Massachusetts' health insurance regulations, including the inclusion of Covered Employees in the Full-Time Equivalents count.
