This bill amends Section 28E of Chapter 278 of the Massachusetts General Laws to require non-indigent defendants who appeal their cases to be responsible for their own costs on appeal, unless the Commonwealth loses the appeal or the Commonwealth's application is denied. In such cases, the defendant is entitled to be reimbursed for the costs incurred, including reasonable attorney's fees, subject to court approval.
