This bill, the Protecting and Enhancing Public Access to Codes Act (or the Pro Codes Act), amends the US Copyright Code to reaffirm the importance of technical and voluntary consensus standards that are incorporated by reference into laws and regulations. The bill recognizes that these standards, developed by private standards development organizations through an open and consensus-based process, are critical to commerce, innovation, and public safety. To balance public access and the need to protect the copyright of these standards, the bill requires that standards development organizations make the incorporated portions publicly accessible online at no monetary cost within a reasonable time after the standard is incorporated by reference. The bill also establishes the burden of proof in any challenge to the copyright protection of an incorporated standard.
