This bill amends Title 42 (Judiciary and Judicial Procedure) of the Pennsylvania Consolidated Statutes to further provide for arrest without warrant. Specifically, it allows police officers to arrest without a warrant, upon probable cause, for certain summary offenses under the Crimes and Offenses title of the Pennsylvania statutes, such as disorderly conduct, public drunkenness, and obstructing highways, when there is ongoing conduct that imperils personal security or endangers property. However, prior to making such an arrest, the officer must first issue a warning or citation and order the individual to cease the unlawful conduct. If the individual refuses or fails to comply, the officer may then make the arrest subject to the provisions of this section. The bill also requires the governmental body employing the police officer to promulgate guidelines to be followed when making a warrantless arrest under this section.
