Bill Summary

AN ACT to amend the general city law, the village law and the town law, in relation to limiting a municipality's authority to impose certain zoning requirements

AI Summary

This bill limits the authority of cities, villages, and towns in New York to impose certain zoning requirements. Specifically, it prohibits cities from establishing a minimum lot size of more than 1,200 square feet, requiring off-street parking as a condition of construction (except for freight/delivery areas), and restricting the construction or occupation of dwellings for four or fewer families (or six or fewer families near transit stations). Similarly, it prohibits villages from establishing a minimum lot size of more than 1,200 square feet, requiring off-street parking as a condition of construction (except for freight/delivery areas), and restricting the construction or occupation of dwellings for two or fewer families (or six or fewer families near transit stations). For towns, it prohibits establishing a minimum lot size of more than 5,000 square feet if the lot has access to sewer and water infrastructure, or more than 20,000 square feet in any area. The bill is set to take effect 180 days after becoming law, and requires cities, towns, and villages to ensure compliance with the new requirements prior to the effective date.
