Bill Summary
AN ACT to amend the penal law, in relation to the criminal sale of a controlled substance to a person less than fourteen years of age
AI Summary
This bill amends the Penal Law to create a new criminal offense called "Criminal Sale of a Controlled Substance to a Child in the First Degree." Under this new provision, a person over the age of 18 who knowingly and unlawfully sells a controlled substance to a person less than 14 years old would be guilty of a class A-II felony, which is a more serious offense than the existing "Criminal Sale of a Controlled Substance to a Child in the Second Degree" that applies to sales to those under 17 years old. The bill aims to further protect children from the dangers of controlled substances.
