This bill prohibits the manufacture, distribution, or sale of certain food additives and food color additives, including brominated vegetable oil (BVO), potassium bromate, propylparaben, azodicarbonamide, butylated hydroxyanisole (BHA), red dye 3, and titanium dioxide (except in dairy products). The bill requires the Commissioner of Agriculture and Markets to amend the exemption list to indicate that these substances are not deemed safe for human consumption in New York State one year after the effective date of the bill. The bill also provides that the recognition by the federal Food and Drug Administration of any of these substances as safe cannot be used as a defense in an enforcement action.
