This bill provides, with certain exceptions, that no provision for arbitration in a contract for health insurance is binding upon any person insured under the contract who makes a claim. It repeals certain provisions related to provisions for arbitration in a contract for health insurance. The key provisions of this bill include: 1. Prohibiting binding arbitration clauses in various types of health insurance policies, including individual health insurance, group/blanket health insurance, health benefit plans, benefit contracts, hospital/medical/dental service contracts, health maintenance organization evidence of coverage, dental care plans, prepaid limited health service organization evidence of coverage, and managed care organization evidence of coverage. 2. Requiring any such contracts that contain an arbitration provision to include a statement that the arbitration provision is not binding. 3. Exempting contracts between a plan sponsor and a hospital or health care provider from these requirements. 4. Repealing existing statutory provisions related to arbitration requirements in certain health insurance contracts. The bill is intended to provide consumers more choice and control over dispute resolution options when making claims under their health insurance policies.
