This bill aims to ensure access to prescription medications by regulating the practices of pharmacy benefits managers (PBMs) and covered entities. It requires PBMs and covered entities to make their maximum allowable cost lists and sources publicly available, ensure that maximum allowable costs are equal to or greater than pharmacies' acquisition costs, and update the lists every three business days. The bill also establishes a process for pharmacies to appeal the cost of a particular drug or medical product, and prohibits PBMs from applying retroactive discounts. Additionally, the bill requires MassHealth Managed Care Organizations and Accountable Care Organizations to reimburse pharmacies at the same rate as described in the MassHealth Pharmacy Provider Manual, and allows pharmacists to disclose certain healthcare information to patients without penalty.
