This bill enacts the "Low Impact Landscaping Rights Act", which prevents homeowners' associations from adopting or enforcing any rules or regulations that would effectively prohibit, or impose unreasonable limitations on, the installation or maintenance of low impact landscaping. Low impact landscaping includes pollinator gardens, rain gardens, habitat gardens, and natural gardening using native plants. The bill recognizes the importance of biodiversity and the adverse effects of turfgrass monocultures, and aims to ensure that homeowners are not prevented from installing and maintaining such beneficial landscaping on their property. However, the bill allows homeowners' associations to prohibit low impact landscaping on common property, if it is not reasonably maintained, or if it poses safety or encroachment concerns.
