This bill, known as "The Equity in Fertility Treatment Act," amends the insurance law in New York to expand the definition of "infertility" and to require health insurance coverage for in-vitro fertilization (IVF) treatments. The bill defines infertility as the failure to establish a clinical pregnancy after 12 months of regular, unprotected sexual intercourse (or 6 months for individuals 35 and older), a person's inability to reproduce without medical intervention, or a licensed physician's findings based on the patient's medical, sexual, or reproductive history, age, physical findings, or diagnostic testing. The bill also requires insurance policies to cover three completed oocyte retrievals and unlimited embryo transfers from fresh or frozen oocytes or embryos, in accordance with guidelines from the American Society for Reproductive Medicine, using single embryo transfer when recommended. Additionally, the coverage cannot be denied based on an individual's participation in fertility services provided by or to a third party.
