DIVISION I —— MEDICAID EXTENDED POSTPARTUM COVERAGE. Under current federal law, pregnant Medicaid beneficiaries are eligible for at least pregnancy-related services through the end of the month in which the 60-day period beginning on the last day of the pregnancy ends. Provisions of the federal American Rescue Plan Act of 2021 (H.R. 1319) provide the option to states to submit a state plan amendment to provide postpartum Medicaid coverage for 12 months after the end of a pregnancy for a five-year period. A provision under the federal Consolidated Appropriations Act of 2023 removed the five-year limitation. This division requires the department of health and human services (HHS) to submit a Medicaid state plan amendment to the centers for Medicare and Medicaid services of the United States department of health and human services for approval of the new option to provide 12 months of continuous postpartum coverage under the Medicaid program to pregnant women enrolled in the Medicaid program. The division of the bill takes effect upon enactment. DIVISION II —— MEDICAID EXTENDED POSTPARTUM COVERAGE —— APPROPRIATION. This division of the bill appropriates moneys from the general fund of the state to HHS for FY 2023-2024 and FY 2024-2025 for the state costs of postpartum coverage under the Medicaid program.
