Bill Summary
AN ACT to amend the civil practice law and rules, in relation to the obligation to file an application for extreme risk protection order
AI Summary
This bill amends the Civil Practice Law and Rules to allow a police officer or district attorney discretion in filing an application for an extreme risk protection order, rather than requiring them to do so. Previously, the law required them to file such an application upon receiving credible information that an individual is likely to engage in conduct that would result in serious harm to themselves or others. The bill now gives them the option to forego filing the application if they determine there is no probable cause to do so.
