This bill provides for restrictions on the sale and application of high-PAH (polycyclic aromatic hydrocarbons) sealants, which are products containing more than 0.1% PAHs by weight. It establishes the Safer Sealant Fund to be administered by the Department of Environmental Protection (DEP) to further the purposes of the act. The bill authorizes municipalities to enact ordinances that prohibit the supply, sale, or application of high-PAH sealants within their jurisdictions, and allows them to enforce the act concurrently with the DEP. Violations of the restrictions are subject to civil penalties of up to $2,500. The bill also requires the DEP to draft a model municipal ordinance for those municipalities that choose to enforce the provisions.
