This bill amends the Environmental Conservation Law to address false claims about the recyclability of products and packaging. It prohibits deceptive claims that a product or package is recyclable unless it can be collected, separated, or otherwise recovered through an established recycling program. The bill requires the Department of Environmental Conservation to develop regulations on the types and forms of plastic products and packaging for which a claim of recyclability may be made, based on specific criteria. It also requires all rigid plastic bottles and containers sold in New York to be labeled with a resin identification code, and prohibits the use of the chasing arrows symbol unless the product is actually recyclable in the state.
