Bill Summary
AN ACT to amend the domestic relations law, in relation to allowing for no fault separation
AI Summary
This bill amends the Domestic Relations Law to allow for no-fault separation where the relationship between the spouses has broken down irretrievably for a period of at least six months, as long as issues related to support, custody, and visitation have been resolved by the parties or determined by the court. Previously, the law required one or more years of separation before a divorce could be granted. The bill also reduces the required period of separation under a decree or agreement from one year to six months.
