This bill provides for the nonpreemption of measures by state and local governments to divest from entities that engage in boycott, divestment, or sanctions (BDS) activities targeting Israel or persons doing business in Israel or Israeli-controlled territories. It allows states and localities to adopt and enforce such measures, as long as they meet certain requirements, such as providing notice to affected entities and allowing them an opportunity to comment. The bill also provides a safe harbor for asset managers to change their investment policies to avoid investing in entities that engage in BDS activities, and expresses the sense of Congress that ERISA plan fiduciaries may divest from or avoid investing in such entities under certain conditions. Finally, the bill includes a rule of construction to ensure that the bill does not infringe on any rights protected under the First Amendment.
