AI Summary
This bill amends Section 20101b of the Natural Resources and Environmental Protection Act to revise references to powers of attorney in order to reflect the adoption of the Uniform Power of Attorney Act. Specifically, the bill clarifies that lenders or other persons acting in a fiduciary capacity, including under a durable power of attorney, are not personally liable as owners or operators of a property under certain conditions, such as not participating in the management of the property before assuming ownership or control. The bill also includes provisions related to claims that can be asserted against the fiduciary in their representative capacity. The bill will only take effect if House Bill No. 4644 is also enacted into law.
