This bill amends the Civil Practice Law and Rules to provide additional requirements for certain writings and records to be admissible under the business records hearsay exception. Specifically, it requires that the writing or record be made upon the recorder's own personal knowledge or from information given by someone with personal knowledge and a business duty to transmit the information accurately, or from information subject to a hearsay exception. For hospital or medical office records, the entry must also be germane to the patient's treatment or diagnosis. The bill also addresses the admissibility of electronic records as business records.
