Bill Summary

This bill establishes the crime of gang assault. A person commits gang assault, a crime of the third degree, when with intent to cause bodily injury to another person and when aided by two or more other persons actually present, he causes bodily injury to such person or to a third person. Under the bill, "bodily injury" means physical pain, illness or any impairment of physical condition. A crime of the third degree is punishable by a term of three to five years imprisonment, a fine of up to $15,000, or both. This bill is modeled after New York Consolidated Laws, Penal Law - PEN § 120.06.
