This bill aims to provide equitable sentencing for felony and joint venture murder. It amends the Massachusetts General Laws to strike out language that previously allowed for a killing during the commission or attempted commission of a crime punishable with death or life imprisonment to amount to murder. Instead, the bill stipulates that for a killing to be considered murder, the principal perpetrator must be personally and directly responsible for committing the killing and act with the same malice aforethought as required for murder not done in the course of another offense. The bill also specifies sentencing guidelines for those who aid in the commission of a killing but are not the principal perpetrator.
