AN ACT to amend the labor law, in relation to automated employment decision tools

This bill amends the labor law in New York to require employers and employment agencies to notify job candidates if they use automated employment decision tools, such as machine learning algorithms, to screen candidates. The bill defines an "automated employment decision tool" as any computational process that assists or replaces discretionary decision-making in employment decisions. Employers must notify candidates about the use of such tools, the job qualifications and characteristics the tools will use, and information about the data collected and the employer's data retention policy. Candidates must be notified at least 10 business days before the use of the automated tool and must be allowed to request an alternative selection process or accommodation.
