This bill, the Medicare Common Ownership Transparency Act of 2023, requires Medicare Advantage (MA) organizations and Prescription Drug Plan (PDP) sponsors to disclose certain ownership information related to health care providers and pharmacies. MA organizations must report the taxpayer identification numbers of specified health care providers (those in which the organization or its parent has an ownership or control interest) and the amounts of incentive payments and shared losses recouped from them. PDP sponsors must report the taxpayer identification numbers and National Provider Identifiers of specified pharmacies (those in which the sponsor, its parent, or a pharmacy benefit manager offering services under the plan has an ownership or control interest). The bill also requires the Medicare Payment Advisory Commission to report every three years on vertical integration in the Medicare program, including evaluations of the relationships between ownership and risk scores, drug pricing, and pharmacy utilization for MA and prescription drug plans.
