This bill, the Government Surveillance Transparency Act of 2023, would amend federal law to: - Require eventual notice to targets of criminal surveillance orders, and limit sealing of such orders to 180 days or less, with higher judicial review for longer sealing periods. - Require public disclosure of docket records for criminal surveillance cases, with limited exceptions. - Mandate prompt return of inventories to the court if the government obtained more information than authorized. - Require notice to subscribers or customers within 7 days when the government receives their records or communications, unless notice is delayed. - Reform the use of nondisclosure orders to service providers, including higher standards for extensions beyond 180 days. - Provide grants to state and tribal courts to help implement the new requirements. - Modernize reporting requirements on government access to customer records and use of pen registers/trap and trace devices. The bill aims to increase transparency and oversight around government criminal surveillance activities, while preserving exceptions for cases where secrecy is truly necessary.
