AI Summary
This bill, known as Karina's Law, introduces significant changes to how firearms are handled in domestic violence protection orders in Illinois. Specifically, the bill authorizes courts in criminal proceedings to issue orders that prohibit individuals subject to domestic violence protection orders from possessing firearms or firearm parts that could be assembled into an operable firearm. Under the new law, when a domestic violence order of protection is issued, the respondent must surrender any firearms and firearm parts to law enforcement within 24 hours of being served. Law enforcement is empowered to seek search warrants to seize these items if the court finds the respondent poses a credible threat to the petitioner's safety. The bill also establishes detailed procedures for the safekeeping of surrendered firearms, including provisions for their potential return at the end of the protection order, transfer to a third party, or disposal. Additionally, the law requires law enforcement agencies to provide an itemized receipt of seized items and allows for the return of firearms to the respondent or a designated third party if certain conditions are met. The bill aims to enhance the safety of domestic violence victims by restricting firearm access for individuals deemed to pose a potential threat.
