This bill, the Government Surveillance Reform Act of 2023, proposes several key reforms relating to foreign intelligence surveillance authorities: It prohibits warrantless queries for communications and information of U.S. persons or persons in the U.S. under Section 702 of the Foreign Intelligence Surveillance Act (FISA), with limited exceptions. It also limits the use of information obtained under Section 702 in criminal, civil, and administrative proceedings, and repeals the authority for "about" collection under Section 702. The bill adds additional court oversight and transparency requirements for FISA activities, including mandatory appointment of amici curiae, disclosure of relevant information in FISA applications, and declassification of significant FISA Court decisions. It also imposes data retention limits and minimization procedures for information collected under FISA and Executive Order 12333. Additionally, the bill extends certain FISA authorities for 4 years and includes various other reforms to electronic communications privacy laws and regulations around government surveillance.
