This bill makes several key changes related to surrogacy programs and criteria for surrogacy agreements, as well as gamete donation matched agreements and gamete donation agency agreements. The bill provides for a gamete donor's bill of rights and a bill of rights of donor-conceived and surrogate-born individuals, regulates certain activities of surrogacy programs, and provides for enrollment in the health market exchange insurance programs. Specifically, the bill: establishes new definitions and requirements for surrogacy agreements and gamete donation agreements; creates a central assisted reproduction registry to track data on surrogacy and gamete donation; provides rights for gamete donors, donor-conceived individuals, and surrogate-born individuals; requires informed consent procedures for participants; limits the number of donor-conceived individuals born from a single donor's gametes in New York; prohibits nonidentified gamete donation; and allows for special enrollment periods in the state health insurance exchange for persons acting as surrogates and egg donors.
