This bill requires health insurance coverage for testing of the breast cancer 1 (BRCA1) and breast cancer 2 (BRCA2) genes. Specifically, the bill mandates that various types of health insurance plans, including hospital service corporation contracts, medical service corporation contracts, health service corporation contracts, individual and group health policies, and health maintenance organization (HMO) enrollee agreements, must provide benefits for BRCA1 and BRCA2 gene testing. Additionally, the bill establishes that a positive test result for these genes can be considered "positive genetic testing" for breast cancer, which allows for additional testing under current law. The provisions of the bill apply to policies and contracts delivered, issued, executed, or renewed on or after the effective date, which is 90 days after enactment.
