This bill establishes a rebuttable presumption that a person charged with theft of a motor vehicle be detained prior to trial. Specifically, the bill amends existing law to add theft of a motor vehicle as a crime for which there is a rebuttable presumption that the defendant should be detained pending trial, as the court may find that no amount of monetary bail or other conditions would reasonably assure the defendant's appearance, protect public safety, or prevent obstruction of the criminal justice process. The bill provides for a pretrial detention hearing and the ability for the defendant to appeal an order of pretrial detention.
