Bill Summary

AN ACT to amend the penal law, in relation to enacting "Chelsey's law"

AI Summary

This bill, titled "Chelsey's law," amends the penal law to establish that a person commits the crime of manslaughter or aggravated manslaughter when they know or have reasonable grounds to know that a controlled substance is likely to cause the death of another person, and they sell, administer, deliver, or cause the delivery of that substance, which then causes, contributes to, or aids in the death of that person. The bill also introduces a presumption that the sale, administration, delivery, or caused delivery of a controlled substance by someone other than a licensed medical professional is evidence that the person knew or had reasonable grounds to know the substance was likely to cause death. Additionally, the bill enhances the penalties for manslaughter in the second degree when certain aggravating factors are present, such as selling to a minor or using a substance known to have caused a previous death.
