This bill, known as the "Pressley Cavin Stutts, Jr., Patient and Health Provider Protection Act," adds a new section to the South Carolina Code of Laws to authorize the prescribing and dispensing of off-label medications, with certain exceptions. It requires pharmacists to dispense and hospitals or inpatient facilities to allow the dispensing of off-label drugs prescribed by a licensed healthcare provider, unless the pharmacist, hospital, or facility has a moral, ethical, or religious objection or the patient has a history of a life-threatening allergic reaction or contraindication. The bill also provides immunity from liability for healthcare providers and facilities in certain circumstances related to the dispensing and use of off-label drugs, and prohibits state and local governments from enforcing federal rules or orders that prohibit the prescribing or dispensing of such drugs.
