This bill makes several changes related to industrial hemp and cannabinoid products in Utah: This bill modifies and enacts provisions related to industrial hemp. It updates definitions related to industrial hemp, cannabinoid products, and transportable industrial hemp concentrate. It allows the Department of Agriculture and Food to establish standards for testing and disposing of industrial hemp and cannabinoid products, as well as requirements for registering industrial hemp processors and retailers. It prohibits the transport of industrial hemp with a THC concentration above 0.3% and requires the Department of Agriculture and Food to share information with the State Tax Commission about retailers selling cannabinoid products starting in 2025. The bill also creates a new Cannabinoid Licensing and Tax Act. This act requires retailers to obtain a license from the State Tax Commission to sell cannabinoid products and imposes a 10% tax on the retail price of those products. The revenue from the tax will be used for enforcement, investigations, an industrial hemp grant program, and distribution to local governments.
