This bill creates a new section in Florida law (s. 256.045, F.S.) that prohibits governmental entities, including public schools, colleges, and universities, from erecting or displaying flags that represent a political viewpoint. The bill requires these governmental entities to remain neutral when displaying flags and to ensure the United States flag is displayed in a prominent position. The bill also authorizes active or retired members of the U.S. Armed Forces or National Guard to use reasonable force to prevent the desecration, destruction, or removal of the U.S. flag, or to replace it to a prominent position, except when directly ordered not to do so by a law enforcement officer. The bill takes effect on July 1, 2024.
