Bill Summary

AN ACT to amend the election law, in relation to providing a remedy for election disruptions

AI Summary

This bill amends the New York election law to provide a remedy for election disruptions. The key provisions are: 1. If early voting or election day voting is delayed or disrupted for more than 15 consecutive minutes at one or more polling places or election districts, the board of elections must toll, adjust, and extend the scheduled timeframe for voting on that day to account for and compensate the lost time. The board must use reasonable means to publicly announce the remedial action taken. 2. The board of elections can determine that the additional time remedy is unnecessary under the specific circumstances, but must inform state and local officials and describe their reasoning. 3. Election inspectors must immediately notify the board of elections of any delay or disruption exceeding 15 minutes, and there is a presumption of a violation if someone intentionally frustrates this reporting requirement. 4. The bill also clarifies that a change in early voting polling place location cannot occur within 48 hours of the start of early voting unless it is due to a disaster or disruption.
