This bill establishes that the statute of limitations for a prosecution relating to harassment by distribution of a deep fake image is 5 years after the victim knew or should have known of the violation. It defines a "deep fake representation" as an image that is indistinguishable from an actual and identifiable human being, and prohibits the knowing distribution of such a representation that displays the person with intimate parts exposed or engaged in sexual activity, with the intent to harm, harass, intimidate, threaten, or coerce the person, and without their consent. The bill also exempts certain activities from this provision, such as lawful law enforcement practices and voluntary exposure in public settings, and limits public access to court records related to such prosecutions.
