Bill Summary

AN ACT concerning Multifamily Dwellings - Smoking Policies FOR the purpose of requiring the governing body of a common ownership community to develop a smoking policy if the property subject to the control of the governing body is a multifamily dwelling; and generally relating to multifamily dwellings in the State. BY adding to Article - Real Property Section 14-134 Annotated Code of Maryland (2023 Replacement Volume)

AI Summary

This bill requires the governing body of a common ownership community, such as a condominium or cooperative housing corporation, to develop a smoking policy if the property under its control is a multifamily dwelling with four or more units. The policy must be at least as stringent as applicable state and local laws, and must specify where smoking is authorized and prohibited, any conditions on smoking in authorized areas, the process for filing complaints, and any penalties or fines for violations. The bill does not limit the rights of the governing body, tenants, or residential owners to initiate or defend civil actions, and it does not preempt local governments from enacting and enforcing more stringent smoking policies for multifamily dwellings.
