This bill would, beginning January 1, 2032, prohibit the distribution, sale, or offering for sale of products that contain intentionally added per- and polyfluoroalkyl substances (PFAS) in California, unless the Department of Toxic Substances Control (DTSC) has determined that the use of PFAS in the product is a currently unavoidable use, the prohibition is preempted by federal law, or the product is previously used. The bill establishes a process for DTSC to evaluate and grant determinations of currently unavoidable use, which would expire after five years and could be renewed. The bill also requires DTSC to maintain a list of these determinations on its website and imposes administrative penalties for violations. Additionally, the bill requires DTSC to adopt regulations to administer the bill, including establishing an application fee and an administrative appeal process.
