This bill establishes clear authority for the Secretary of Health to issue standing orders for any biological product, device, or drug to control, prevent, mitigate, or treat any infectious or non-infectious disease or public health threat. The Secretary or their designee must hold a valid license and comply with applicable licensing requirements. The Secretary has sole discretion in issuing these standing orders and is not liable for any civil or criminal damages, except for gross negligence or willful misconduct. The bill also allows the Secretary, their designee, and department employees to acquire, possess, deliver, dispense, and administer these products under the standing orders, as long as they hold the necessary licenses. The bill does not allow the Secretary to require a person to take a drug or biological product or withhold it from a person.
