Bill Summary

This bill upgrades the offense of criminal mischief if a person interrupts or impairs the supply of power. Under current law, criminal mischief is a crime of the third degree if a person purposely or knowingly causes a substantial interruption or impairment of public communication, transportation, the supply of water, oil, gas, or power or other public service. Criminal mischief is a second degree crime if the substantial interruption or impairment recklessly causes death. Under the provisions of this bill, all criminal mischief offenses are a second degree crime if a person purposely or knowingly causes a substantial interruption or impairment of supply of power A third degree crime is punishable by three to five years imprisonment, a fine of up to $15,000, or both. A second degree crime is punishable by five to 10 years imprisonment, a fine of up to $150,000, or both.
