Bill Summary

This bill amends section 3 of P.L.2019, c.300 (C.46:8-49.2), to expand the definition of landlords required to provide a receipt for a rent cash payment made by a tenant. This bill expands the definition of a "landlord" to include any person who rents or leases or offers to rent or lease, for a term of at least one month, one or more dwelling units, except dwelling units, hotels, motels or other guest houses serving transient or seasonal tenants. Under current statute, a landlord includes any person who rents or leases or offers to rent or lease, for a term of at least one month, dwelling units, except dwelling units in rental premises containing not more than two such units, or in owner-occupied premises of not more than three dwelling units, or in hotels, motels, or other guest houses serving transient or seasonal guests.

AI Summary

This bill expands the definition of a "landlord" who is required to provide a receipt for cash rent payments made by a tenant. Previously, this requirement applied to landlords of dwelling units, with exceptions for smaller rental properties (two or fewer units) or owner-occupied properties (three or fewer units), as well as hotels and motels serving temporary guests. The bill now includes landlords who rent or lease dwelling units for at least one month, regardless of the number of units, as long as they are not hotels, motels, or other guest houses catering to transient or seasonal tenants. This change means more landlords will be obligated to provide tenants with a detailed receipt for cash rent payments, specifying the amount, purpose, date, names of landlord and tenant, and who accepted the payment, with penalties for non-compliance and a defense for tenants if the landlord violates this rule.
