This bill establishes a unified procedure for the Department of the Treasury to certify businesses as LGBTQ+ businesses, meaning businesses where at least 51% of ownership and control are held by individuals who identify as lesbian, gay, bisexual, transgender, queer, questioning, or other non-cisgender and non-heterosexual identities. The department will set clear criteria for certification, denial, and revocation, and will provide a single, plain-language application form to avoid redundant paperwork for applicants. The department will also annually verify the status of certified businesses, maintain public lists of these businesses, and establish an appeal process for any denials or revocations. To facilitate growth, the department can enter into reciprocal agreements with other certifying entities, provided their programs are similar. All submitted application information will be kept confidential, except as required by law or during an appeal process. This act, which defines terms like "LGBTQ+" and "LGBTQ+ business," will take effect 180 days after enactment.
